Felony DWI - Leandra's Law Arrest

On May 28th 2018 at approximately 6:54 PM 42 year old Nivea Cardoso of Clifton Park, New York was arrested on Albany Avenue in the Village of Nassau for Felony Aggravated DWI under “Leandra’s law”. Ms. Cardoso was stopped for speeding on Church Street. Upon stopping the vehicle it was observed there was an unrestrained juvenile passenger in the vehicle, a 9 year old. Ms. Cardoso's BAC was 0.13%, she faces the following charges:

VTL §1192-2AB – Aggravated DWI: With a Child as passenger less 16 years old – Class E Felony
PL §260.10(1) - Endangering the welfare of a child - Class A Misdemeanor
VTL §1192-2 – DWI per se; .08% or more of alcohol in blood – Misdemeanor
VTL §1192-3 –DWI – Misdemeanor
VTL §512 - Suspended Registration - Misdemeanor
VTL §511-1A Aggravated Unlicsened Operation in the 3rd Degree - Misdemeanor
VTL §1180-D – Speed in Zone - Traffic Infraction
VTL §1229-C1C - Backseat passenger under 15 no seat belt - Traffic Infraction

Ms. Cardoso was arraigned in the Village of Nassau Court by Justice Michael Conway and remanded to Rensselaer County Jail in lieu of $1,500 bail. Her next appearance will be in Nassau Village Court on 6/5/2018 at 6:30 PM.

Criminal Possession of a Controlled Substance Arrest

On May 26th 2018 at approximately 10:35 PM 50 year old Steve Matala of Schaghticoke, NY was arrested for 2 counts of Criminal Possession of a Controlled Substance in the 7th degree after a traffic stop. Mr. Matala was a passenger in a vehicle that was stopped for speeding. He was in possession of concentrated cannabis and acetaminophen with hydrocodone. He was arrested then processed at Nassau Police Station and released with appearance tickets to appear in Nassau Village Court on 6/5/2018 at 6:30PM.

On May 11th 2018 at approximately 9:20 PM 32 year old Natalia Briggs of Troy, New York was arrested on Albany Avenue in the Village of Nassau for Felony Aggravated DWI under “Leandra’s law”. Mrs. Briggs was stopped for speeding on Church Street. Upon stopping the vehicle it was observed there were 2 juvenile passengers in the vehicle, an 8 and an 11 year old. Mrs. Briggs' BAC was 0.08%, she faces the following charges:

VTL §1192-2AB – Aggravated DWI: With a Child as passenger less 16 years old – Class E Felony
PL §260.10(1) - Endangering the welfare of a child - Class A Misdemeanor
VTL §1192-2 – DWI per se; .08% or more of alcohol in blood – Misdemeanor

Mrs. Briggs was released with appearance and traffic tickets to appear in Nassau Village Court on 6/5/2018 at 6:30 PM.
